Motor Vehicle Aministration Hearings

While a vast majority of MVA hearings deal with alcohol related offenses, there are a wide variety of MVA hearings which arise when a licensed driver fails to pay child support, accumulates too many points on their driving record, fails to comply with the Interlock Ignition Program, or fails to complete a driver improvement program.

DUI / DWI Hearings

  • Refusal of a breathalyzer test may result in losing your driver's license for up to 270 days.

  • A breathalyzer test of at least .08 may result in losing your driver's license for up to 180 days.

  • If you hold a commercial driver's license (CDL), you can be subject to enhanced penalties.

  • No matter what your test result was or whether you refused to take a breathalyzer test, you may have options that will allow you to keep your driving privilege, such as obtaining a restricted license to drive to and from work or installing an interlock ignition device in your vehicle.

If you refuse a breathalyzer test or score higher than .08 BAC, you will automatically have your driver's license confiscated and be issued a 45 day temporary license. You will then have only ten days to request a hearing to show cause why your driver's license should not be suspended.  If you have obligations such as school, employment, health care treatment, or child care obligations, it is crucial that you have an experienced attorney by your side, fighting for your right to drive.
